STATE WORKERS COMPENSATION ACT IT’S THE LAW!
Workers compensation insurance provides medical and some disability benefits coverage for on-the-job injuries and disease. Workers compensation coverage is available in all states except North Dakota, Ohio, Washington, and Wyoming. USL&H also known as Longshore Harbor Workers Compensation Act coverage is provided to those employees with exposure to navigable waters of the United States. Jones Act coverage designed to provide employee benefits for employees with a seaman status of a US-flagged vessel.
DEATH ON THE HIGH SEAS ACT (DOHSA)
Covers any death occurring beyond 3 nautical miles from the shore of any State. Only the personal representative of the deceased individual can bring a DOHSA action, and that action is pursued on behalf of, or for the benefit of the decedent’s spouse, child(ren), parent or other financially dependent relative. DOHSA actions only provide for the recovery of monetary damages and does not provide for recovery of non-pecuniary damages.
Policy premiums are based on estimated annual payroll and the nature of your business. “1099” wages should be included unless the subcontractor has their own workers’ compensation insurance coverage. A number of insurance carriers are available to provide workers’ compensation coverage.
Virtually all businesses with employees are eligible for coverage. Many states treat business owners as employees.
